Terms of Service

Draft for review. These terms have not been checked by a lawyer and must be reviewed before launch, particularly because the seller is established in the Netherlands while selling to consumers in Australia and the United States, where different mandatory consumer protections apply.

1. Who we are

This store is operated by Away.Equipe, trading as Maddison Boutique, company number 97474673, VAT number NL004753130B67, registered at Burgemeester van Tienhovengracht 45-1, 1064 BE Amsterdam, Netherlands. "We", "us" and "our" refer to that company.

2. These terms

By placing an order you agree to these terms. We may update them, and the version in force at the time of your order is the version that applies to that order.

3. Orders

Your order is an offer to buy. A contract is formed when we confirm dispatch. We may decline an order, for example where an item is unavailable or where a price has been listed in error, and we will refund any payment taken in full.

4. Prices and payment

Prices are shown in the currency displayed at checkout and include applicable taxes unless stated otherwise at checkout. Any comparison or "was" price shown is the price at which the item was previously offered by us. Payment is taken at the time of order.

5. Delivery

We deliver to Australia and the United States. Processing takes 3 to 5 business days and delivery a further 5 to 10 business days. These are estimates, not guarantees. Risk in the goods passes to you on delivery.

6. Returns and cancellation

You may request a return within 30 days of delivery. Items must be unworn, unwashed and in original condition with tags attached. Refunds are issued to the original payment method within 10 business days of us receiving and inspecting the return. Nothing in these terms limits any statutory right of return or cancellation available to you under the consumer law of your country of residence.

7. Faulty or incorrect items

If an item arrives damaged, defective or incorrect, contact us within 7 days of delivery and we will arrange a replacement or full refund at no cost to you. This is in addition to, and does not replace, your statutory rights.

8. Product information

We take care to describe products and show colours accurately, but screens vary and minor variation between the image and the item is possible.

9. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded, including under the Australian Consumer Law where it applies to your purchase.

10. Intellectual property

All content on this site, including text, images and the Maddison Boutique name and logo, belongs to us or our licensors and may not be reproduced without permission.

11. Privacy

Personal data is handled as described in our Privacy Policy.

12. Governing law

These terms are governed by Dutch law. This does not deprive a consumer of the protection of mandatory provisions of the law of their country of habitual residence.
